Remarks by Judge Lindsey Kushner QC.
We judges, who see one sexual offence trial after another, have often been criticised for suggesting and putting more emphasis on what girls should and shouldn’t do than on the act and the blame to be apportioned to rapists.

There is absolutely no excuse, and a woman can do with her body what she wants and a man will have to adjust his behaviour accordingly.

But as a woman judge, I think it would be remiss of me if I didn’t mention one or two things.

I don’t think it’s wrong for a judge to beg women to take actions to protect themselves.

That must not put responsibility on them rather than the perpatrator – how I see it is burglars are out there, and nobody says burglars are OK, but we do say “please don’t leave your back door open at night, take steps to protect yourselves”.

Girls Girls are perfectly entitled to drink themselves into the ground but should be aware people who are potential defendants to rape, gravitate towards girls who have been drinking. It should not be like that but it does happen and we see it time and time again.

They do it because, first, a girl who is drunk is more likely to agree as they are more disinhibited even if they don’t agree they are less likely to fight a man with evil intentions off.

Even if they manage to have their way with a girl or woman without her consent the likelihood is she will be less likely to report it because she was drunk or cannot remember what happened or feels ashamed to deal with it or, if push comes to shove a girl who has been drunk is less likely to be believed than one who is sober at the time. I beg girls and woman to have this in mind.

They are entitled to do what they like but please be aware there are men out there who gravitate towards a woman who might be more vulnerable than others. That’s my final line, in my final criminal trial, and my final sentence.


Why is everybody up in arms? Her remarks seem reasonable and sensible.

Perfectly sensible comments. If I had a daughter I would warn her in the same way. I think the politically correct would justify themselves by saying why put the onus on the woman. Realistically the dangers are there and a sensible woman would take steps to avoid the danger.

Overall, her comments appear reasonable, yes, but there have to be red lines drawn, and I completely disagree with the above. Nobody should be "entitled" to drink themselves into the ground, whatever sex. (But then I am foresworn the demon brew, so perhaps I'm a bit puritanical in this respect ... :D )

Now firstly, rape is rape, and should be prosecuted as such.

Secondly, drunk is drunk, and drunk and incapable in a public place is an offence (fixed penalty fine). Rather than take your comatose woman (or man) to the nearest A&E, the cops should follow the guidelines, take them to a police-station, put them in a cell, and leave them there till they sober up (all night if necessary, being woken every half-hour under the guidelines to make sure they are OK). I think if a few girls and women, as well as men, finished up in a drunk tank, it might just do them the world of good ......

Thirdly, for goodness sake, let's change the licencing laws and get rid of this all-night drinking. Another one of Blair's failed initiatives ....

I completely agree.

It infuriates me that the responsibility for a drunk young woman is on the clubs, on the taxi drivers, on her friends, on the police everybody but her.

Every week on our local news some young woman is attacked somewhere in the region. The report nearly always says the attack took place between the hours of 2am and 5am. Why dont young girls learn, getting drunk, staggering home and not knowing who or where you are is dangerous.

Of course there shouldn't be men around ready to pounce, but there are, so for Gods sake wise up

It depends how people want to read the comments. If the judge's comments were meant as "It's your own fault, you shouldn't have got drunk" (I don't think they were), then she is wrong because that is blaming the victim and getting close to "You shouldn't dress like that, you are asking for it" which also blames the victim.

If she meant that girls who drink themselves silly are putting themselves more at risk by becoming drunk and incapable and should be aware of the fact, then where's the problem?

Sorry Cromwell but in my opinion if you get that drunk, you are to blame at least 50% anyway

As the report says if I knew there was a burglar in the area but went out and left my house unsecured, would my insurance pay out? Of course it wouldn't, because sadly it's a wicked world out there and we have to take responsibility for ourselves.

Then, of course, there is the issue of getting falling down drunk, agreeing to sex with someone who is not a predator and then shouting rape when the reality dawns in the morning.

Reality for guys? Avoid drunk girls. Avoid girls who seem to dress to entice. In fact, avoid girls you don't know.

Hell of a life though! But that is what we are moving towards.
