Whether you come in as a tourist and overstay or you float over the Channel, you are illegal if you do not get the authority to stay.

This has never changed.

If you are here and have asylu, you are not illegal, if you are in your own country, or a third country and are seeking asylum, you are legal. If you are here since 2016 and seeking asylum, you are illegal.

Trying to make a case for anything else just perpetuates the situation.

I have always been strongly for the immediate turn around and repatriation of illegal immigrants and any asylum seekers using illegal means to get here - no interviews, no processing, just send them back.

However, many asylum seekers, genuine and bogus, arrive here by legal means and they do need processing. That processing should, IMO, be done at holding centres such as ex military camps and the assessments made as speedily as possible. During that time they should be well looked after, fed and given health checks. None of them should ever be allowed into the community until a decision about their status has been made. Those deemed bogus should be sent back to the point from whence they came.

It depresses me that most asylum seekers are allowed into the community pending a decision and that, for many, the decision could take years. It is bad for us, and it is bad for them.

Permission to stay as a refugee
You and your dependants may be given permission to stay in the UK for 5 years if you qualify for asylum. This is known as ‘leave to remain’.

After 5 years, you can apply to settle in the UK.

Permission to stay for humanitarian reasons
You may get permission to stay for humanitarian reasons if you do not qualify for asylum. This means you need to stay in the UK for your protection.

You and your dependants may be given permission to stay in the UK for 5 years. This is known as ‘leave to enter’ or ‘leave to remain’.

After 5 years, you can apply to settle in the UK.

Permission to stay for other reasons
You may get permission to stay for other reasons if you do not qualify for permission to stay as a refugee or for humanitarian reasons.

How long you can stay will depend on your situation.

You may be able to apply to extend your stay or settle in the UK towards the end of your stay.

Any who apply to extend their stay or settle in the UK can do so free of charge once their permission to stay is coming to an end.

Yes, but he didn't do any of those up front WM, did he. He just overstayed then applied for asylum when challenged.

That is a whole world away from those who legitimately enter then apply, in time, accepting if the response is no.

The game is simple. Come, overstay, try to hide for years then apply, if caught, plead oppression and get legal aid to keep you in the country.

One is legal, the other is illegal. To me it does not matter if the government has their arm forced into keeping illegals and give them leave to remain, it doesn't confer legality onto what they did and it does not change how they view the supremacy of UK law. All it does is regularise their situation temporarily.

There is a level of morality here which is being ignored for expediency.

So when governments do this and it all goes horribly wrong, I reserve the right, as a UK citizen, to put my view about how the government is handling illegal entry into, or remain in, the UK.
