Brussels vows swift response to Poland’s ruling against EU law


Ursula von der Leyen said she was deeply concerned by Thursday’s ruling of the Polish constitutional tribunal, which concluded that basic principles of EU law were incompatible with Poland’s constitution.


“I have instructed the commission’s services to analyse it thoroughly and swiftly


“The fact that we say ‘swift’ does not tie us to any specific amount of time,” said the commission’s chief spokesman, Eric Mamer.


Quite. Slow moving entities tend to get killed off. Like the DoDo.

Poland, on the other hand, are riding a very fine line.

Politicians and legal scholars have described the move as a “legal Polexit” that jeopardises Poland’s access to EU funds and the rights of its largely pro-EU population and businesses.


My take is that the fatal mistake they made was to agree to the "rule of law" conditions on the budget, setting a precedent it was hard to turn over. They should have held the budget to ransom until the clause was removed. Now they pay the price.

BRUSSELS/WARSAW, Oct 6 (Reuters) - A European court found on Wednesday that Poland broke democratic norms by appointing judges who are not sufficiently independent, and declared a decision by one such judge to be void, escalating a conflict between the EU and Poland's ruling nationalists.


Polish Prime Minister Mateusz Morawiecki described the ruling as "an attempt to hit at the very heart of the social and legal system", and said it could affect "hundreds of thousands" of Polish legal decisions.

"Naturally, we cannot allow that," he told a news conference in Slovenia, without explaining what steps Poland would take.


Poland's Constitutional Tribunal is separately hearing a challenge brought by Morawiecki's government against the principle that EU law supersedes Polish law, a pillar of the European system.


Wednesday's ECJ ruling leaves the next steps in the hands of Polish courts. But the EU's executive commission can take legal action to enforce it, if it determines that Poland has ignored it.


I shall wait for the next installment of the conflict between Brussels and some obstropolous EU member states.

So what? We're out!

Some of us have accepted the fact and are moving on.

Those most enthralled, besotted and infatuated by things EU are the ones who most wanted to leave at any cost. It is like a brain worm they cannot wheedle out so it keeps on feeding.

A almost feel sorry for them - almost. No, cancel that: I don't give a toss.

You think that problems like this in our closest neighbors should be ignored? Or that it won't affect us if the whole system starts to unravel?

I see more drivel about the US than I see about very serious issues within the EU. People seem to take US drivel more seriously too. Honestly? They, by single country, are our biggest trading partner. But if the EU starts to unravel due to this kind of stuff, it will be a bigger impact than the US falling apart.

It was, after all, you that made a very strong point that the collective market of the EU was our biggest trading partner. Now we no longer "insider" trade with them, it is no longer important to know what is going on? I would contend that it is even more important to know what is going on. Especially as they German constitutional court has been making similar moves. Although the EU doesn't mind it from them so much.

Giving the same response, "so what we left", to every story relating important world current affairs, is not an adult reply.

Well here's another. I am delighted to say that since I got my sovereignty, blue passport and total control back I am full-on CBA. I am sucking it up and getting on with it, as I was endlessly told to do by a certain section of the country - your side, when you won.

And you believe that this massive effort to stop the pandemic has not impacted every country in the world?

The current changes in benefits have nothing to do with Brexit and everything to do with furlough and the other uncontrolled spending that has gone on in the last 18 months.
